Protest Notice: Stop-Work Order for the J11 MAC

On January 7, 2009, Palmetto GBA was awarded the A/B Medicare Administrative Contractor (MAC) contract for Jurisdiction 11 and Home Health and Hospice MAC Jurisdiction C.

The Medicare Part A and Part B MAC for Jurisdiction 11 is comprised of North Carolina, South Carolina, Virginia and West Virginia. It also includes Home Health and Hospice MAC Jurisdiction C, which covers Alabama, Arkansas, Florida, Georgia, Illinois, Indiana, Kentucky, Louisiana, Mississippi, New Mexico, North Carolina, Ohio, Oklahoma, South Carolina, Tennessee and Texas.

On February 2, 2009, the Centers for Medicare & Medicaid Services (CMS) notified us that the U.S. Government Accountability Office (GAO) had received a protest of CMS’ award to Palmetto GBA.

This has resulted in a Stop-Work Order in accordance with Federal Acquisition Regulations. We have been directed to immediately stop all work in support of the contract. This Stop-Work Order is effective until the final resolution of the protest. We anticipate a decision from the GAO on or about May 13, 2009. CMS periodically updates the status of the MAC procurements on their Contracting Reform Web page.

We will continue to share information with you through the Palmetto GBA Web site and listserv as more details become available regarding how these decisions will affect you. You may also reference the CMS article “Preparing for a Transition from an FI/Carrier to a Medicare Administrative Contractor (MAC),” which is available on the CMS Web site.
